المحكمة غير القانونية تثير تهما جديدة
أعلنت المحكمة العــراقية الخاصة عن تهم جديدة موجهة إلى الرئيس العــراقي صدام حسين ورفاقه. بما يشير إلى اعتزام قوات الاحتلال الأمريكية والمحكمة الخاصة التي خلقتها الولايات المتحدة على مواصلة إجراء هذه المحاكمات أمام محكمة ينظر إليها بشكل واسع النطاق على أنها محكمة غير قانونية وغير قادرة على ضمان إجراء محاكمات عادلة.
وتتعلق التهم الجديدة بقضية الأنفال وتأتي في وقت تخضع فيه المحكمة الخاصة إلى ضغوط متزايدة تهدف إلى نقل القضايا إلى محكمة تخضع لإشراف الأمم المتحدة، وقد انضم خبير الأمم المتحدة حول المحاكمات العادلة وكذلك المجموعة العاملة حول الاعتقال الجزافي التابعة للأمم المتحدة إلى طائفة من كبار المحامين الدوليين حيث أدانوا المحكمة مؤخرا بسبب كونها عاجزة عن توفير محاكمة عادلة.
ودعا ليندروديسبوي، خبير الأمم المتحدة إلى نقل إجراءات المحاكمة في القضايا الراهنة إلى خارج العــراق مشيرا إلى إختلالات في تأسيس المحكمة، تؤدي –استنادا إلى محاميي الدفاع – إلى جعل المحكمة غير قانونية، إضافة إلى الفشل المريع للمحكمة في ضمان حقوق الإنسان.
ومن بيت الاتهامات التي يوجهها محاموالدفاع حول لا حيادية المحكمة، أن قاضي التحقيق رائد جوحي الذي أعلن التهم الجديدة، سبق أن أدلى بتصريحات حول تجريم المتهمين بشكل مسبق.
إن التهم الجديدة تؤكد على استعداد الولايات المتحدة والجهات التي تسيطر على المحاكمة على المضي قدما في إجراء هذه المحاكمات غير العادلة من اجل تحقيق غايات سياسية، وفق ما يقوله البروفيسور كيرتس دوبلر، وهومحام دولي في حقوق الإنسان من مستشاري فريق الدفاع عن الرئيس العراقي صدام حسين.

New Charges; Same Illegal Court
The Iraqi special Court announced new charges against Iraqi President Saddam Hussein and his colleagues indicating the willingness of the occupying United States military and the Iraqi special Court, which the US created, to continue with the trials before a Court that is widely perceived as illegal and unable to ensure fair trials.
The new charges concern Anfal and come as the special Court is under increasing pressure to transfer cases to a court under United Nations auspices. Recently both the UN expert on fair trials and the UN Working groups on Arbitrary Detention joined a host of leading international lawyers in condemning the Court as unable to secure defendants human rights and unable to provide a fair trial. The UN expert, Mr. Leandro Despouy, called upon the proceedings in the current case to be moved out of Iraq. He cited deficiencies in the court’s establishment—which defence lawyers say makes the court illegal—as well as its serious failure to ensure human rights.
Among the allegations of impartiality levied at the court by defence lawyers is that Judge Raed Juhi, who made today’s announcement, has made conclusive statements about the guilt of defendants.
“The new charges emphasize the willingness of the United States and those who they control in Iraq, to push forward with unfair trials to achieve their political ends,” said Professor Curtis Doebbler, an international human rights lawyer advising the defense team of Iraqi President Saddam Hussein.
